You Must Follow the Rules to Get That Tax Deduction

It’s easy to donate a car to charity if all you want to do is get rid of it. Simply call a charity that accepts old vehicles and it will tow your heap away. But if you want to maximize your tax benefits, it’s more complicated. Here’s a walk-through of some of the considerations, with the usual proviso that you should discuss these issues with your tax preparer before you act.

You Must Itemize Your Return

If you want to claim a car donation to reduce your federal income taxes, you must itemize deductions. You could itemize even if the donated auto is your only deduction, but that’s usually not the best choice.

Here’s the math: Suppose you’re in the 28 percent tax bracket and the allowable deduction for the vehicle’s donation is $1,000. That will save you $280 in taxes. If you’re in the 15 percent tax bracket and you get that same $1,000 deduction, it will reduce your taxes by $150.

If the car donation is your only deduction, it’s likely that taking a standard deduction would save you thousands more dollars in taxes. The only way that donating a car nets you any tax benefit is if you have many deductions and if their total, including the car, exceeds the standard deduction. And remember, you can always donate as much as you want to charities, but the IRS limits how much you can claim on your tax return.

The Charity Must Qualify

Only donations to qualified charities can provide a tax deduction for you. A qualified charity is one that the IRS recognizes as a 501(c)(3) organization. Religious organizations are a special case. They do count as qualified organizations, but they aren’t required to file for 501(c)(3) status.

To help you determine whether a charity is qualified, the easiest thing to do is to use the IRS exempt organizations site, or call the IRS toll-free number: 877-829-5500.

A Key Concept: Fair Market Value

The IRS defines fair market value as “the price a willing buyer would pay and a willing seller would accept for the vehicle, when neither party is compelled to buy or sell and both parties have reasonable knowledge of the relevant facts.” In this scenario, neither the buyer nor the seller can be an auto dealer. Both must be private parties.

What complicates the matter for taxpayers is that under current IRS rules, you can only deduct a vehicle’s fair market value under four very specific conditions:

1. When a charity auctions your car for $500 or less, you can claim either the fair market value or $500, whichever is less.

2. When the charity intends to make “significant intervening use of the vehicle.” This means the charity will use the car in its work.

3. When the charity intends to make a “material improvement” to the vehicle, not just routine maintenance.

4. When the charity gives or sells the vehicle to a needy individual at a price significantly below fair market value.

Determining Fair Market Value

Edmunds can help you determine your vehicle’s fair market value with its Appraise Your Car calculator. Enter the car’s year, make and model, as well as such information as trim level, mileage and condition. By looking at the private-party value, you’ll get an accurate idea of what your vehicle is worth.

Note the caution from IRS Publication 4303: “If you use a vehicle pricing guide to determine fair market value, be sure that the sales price listed is for a vehicle that is the same make, model and year, sold in the same condition, and with the same or substantially similar options or accessories as your vehicle.”

Getting Fair Market Value Is Rare

It’s not realistic to expect that your car will meet one of the stringent fair market value requirements. Only about 5 percent of donated vehicles are suitable for use by charity recipients. About a third of donated cars are junked, and the rest are auctioned off.

So unless your car is in good or excellent condition, it will most likely be sold at auction or to an auto salvage yard. In that case, your deduction is based on the car’s selling price, not your estimate of its fair market value. And note that this price is not necessarily something you’ll know when you donate the vehicle, or even before the next tax-filing time, since an organization has up to three years to sell your car.

Getting tax benefits for a donated car requires a lot of documentation, whether the car is junked, sold at auction or given to a charity’s client. IRS Publication 4303 has all the details. Be sure to keep all the papers or electronic files. You’ll need them at tax time.

If there’s a delay in getting paperwork from the charity, your first option, according to IRS Publication 526, is to file Form 4868. That’s a request for an automatic six-month extension of time to submit your return. Your second option is to file the return on time without claiming the deduction for the qualified vehicle. When the charity finally sends your notification, you can file an amended return using form 1040X to claim the deduction. You’ll have to attach a copy of the notification to your 1040X.

Another Approach To Car ‘Donation’

Besides giving your car directly to a charity, there is another way your vehicle can help a charity and also maximize your tax benefits: You can sell the car yourself and donate the proceeds. By doing so, you might be able to generate more cash than if you let the charity sell it.

Parting with your old vehicle could help a nonprofit carry out its mission and also might make room in your garage for a new car. But how you proceed depends on your goal. If you’re focused on getting rid of a junker with minimal effort and you’d look at the tax deduction as a nice bonus, then donating your car makes good sense. But if your goal is to maximize your tax deduction, carefully review these steps, consult with your tax adviser and then make an informed decision.

Car Insurance for tourists in Florida – What you need to know before you rent a car

Car accidents and injuries happen, and insurance may help to protect the parties involved in an accident or other event resulting in personal injury or death, but insurance might not provide coverage in all cases. If you are injured in Florida – or elsewhere in the United States – you should be aware that many different types of insurance may provide you with protection and a source of recovery for injuries and wrongful death.

The following should serve as a guide to understand what kind of insurance coverage to choose.

Bodily Injury Liability
Bodily Injury Liability Coverage covers expenses related to the injury or death of another driver or a pedestrian when an accident is the insured’s fault. This is the coverage that would most likely apply in the event a non-resident was injured by an insured driver and that driver was at fault.

Property Damage Liability
This type of coverage indemnifies the insured driver when they are at fault for expenses related to the damage of another person’s property, such as vehicles, homes, and other buildings. For example, if a non-resident’s own vehicle or vacation home were damaged by a negligent insured driver, the non-resident’s property would be covered by the at-fault driver’s property damage liability coverage.

Uninsured or Underinsured Motorist
This coverage covers medical expenses in the event the insured driver is injured in an accident and the other driver, who does not have any insurance, is at fault.

No-Fault Insurance
This type of coverage does not exist in every state, but it is required in Florida. In general, no-fault insurance is any type of insurance where the insured’s own insurance company indemnifies or compensates the insured for their losses, regardless of who is actually at fault or caused the damage.

Under Florida’s Motor Vehicle No-Fault Law, motor vehicle owners are required to obtain at least $10,000 in no-fault coverage from their auto insurance company. This coverage is called Personal Injury Protection, or PIP. (Fla. Stat. §§ 627.733, 627.736.) PIP is meant to provide coverage for the immediate emergency medical expenses following an accident in order to avoid out-of-pocket expenses, but non-residents should be aware that PIP might not apply to them.

Examples of instances where PIP benefits will not be available to non-residents of Florida are:

  • A non-resident passenger in the insured’s motor vehicle is injured while travelling outside the state of Florida
  • A non-resident pedestrian is injured by an insured driver

Of course, non-residents may eventually be able to recover medical expenses and other damages under one of the other types of coverage. Also, non-residents of Florida who keep a motor vehicle in Florida which has been present in the state for more than 90 days in the previous year are required to maintain an auto insurance policy which meets the PIP requirements for as long as the vehicle is kept in Florida. (Fla. Stat. § 627.733(2)).

How does this apply to Rental Car Insurance?
Most car rental agencies offer two basic products, Loss-Damage Waiver and Liability. Loss-Damage Waiver protects the renter from all financial responsibilities for theft, vandalism, loss or damage to the rented car. Supplemental Liability Insurance protects the renter from lawsuits by victims of accidents in the same way as Bodily Injury Liability and Property Damage Liability would on a driver’s own insurance.

Drivers who rent a car may also be covered under their own insurance policies, or, if paying by credit card, by rental insurance provided by the credit card company. However, it is important to know if you are already covered before deciding to decline the rental agency’s insurance.

Given Florida’s popularity as a travel destination, it is important for non-residents to be prepared and well-informed in the event an automobile related injury or death occurs. The Associate of Applied Science in the Automotive Technology program provides a comprehensive study in automobile maintenance and repair. The program will emphasize skills needed to help the student function successfully in the field, including exposure to the skills needed for new technology as it evolves. The AAS will include all 8 ASE (Automotive Service Excellence) areas and cover all the tasks set forth by ASE/NATEF. A key component of the program is to help students become self-directed learners and develop life-long learning skills. Students must pass all occupational courses with a 2.0 or higher. Returning students who have AUTO classes more than 5 years old must repeat the class unless they are current Michigan or ASE certified in that area. Note: students must provide their own hand tools and safety glasses.

How The Amount Of Your Vehicle Donation is Determined

A vehicle donation can be a great way to get a deduction on your taxes. Thanks to new tax law that went into effect in January 2005, the IRS has simplified the process by taking the guesswork out of determining the value of your vehicle.

As of January 2005, you may deduct the full price we receive for the sale of your vehicle. This greatly simplifies the process for you, the donor, because you no longer have to research and come up with an estimate of the fair market value of the vehicle.

This also eliminates the risk of you getting into trouble by overstating the value of your deduction on your tax return. You’ll know exactly the amount you may deduct, eliminating guesswork. This saves you both time and risk.

The IRS allows you, the taxpayer, to claim a tax deduction of

  • a) The value of your vehicle up to 500 or
  • b) If we sell the vehicle for more than 500, we will mail you a notification stating the exact amount for which it sold, which is the value you state for your tax purposes.
  • c) Fair market value in some cases for certain vehicles. For example, late model cars or vans that end up being used to further the work of our charity OR vehicles on which we make a significant material improvement such as a major repair, before selling it. ( * See more on this option below.)

In any case, you will receive a receipt at the time that your vehicle is picked up.

Assuming that we sell your vehicle for more than 500, we will then mail you a notification stating that value for your tax purposes. So for any vehicle sold for more than 500, the exact amount it is sold for will be stated on your notification mailed to you, which in turn will be your tax deduction.

If a charity intends to make significant intervening use of or materially improve the car, the donor generally can deduct its fair market value.

�Significant intervening use means that a charity must actually use the car to substantially further its regularly conducted activities, and the use must be considerable. There is no significant intervening use if the charity’s use is incidental or not intended at the time of the contribution.

�Material improvement includes a major repair or improvement that results in a significant increase in the car’s value. Cleaning, minor repairs, and routine maintenance are not material improvements.

�The charity must provide the donor with a contemporaneous written acknowledgement of the donation. Without an acknowledgement, the donor cannot deduct the contribution.

Contributions of Property and Fair Market Value:

If you contribute property to a qualified organization, the amount of your charitable contribution is generally the fair market value of the property at the time of the contribution. Fair market value is the price at which property would change hands between a willing buyer and a willing seller, neither having to buy or sell, and both having reasonable knowledge of all the relevant facts. Determining Fair Market Value:

Cars, boats, and aircraft: If you contribute a car, boat, or aircraft to a charitable organization, you must determine its fair market value.

Certain commercial firms and trade organizations publish guides, commonly called blue books, containing complete dealer sale prices or dealer average prices for recent model years. The guides may be published monthly or seasonally, and for different regions of the country. These guides also provide estimates for adjusting for unusual equipment, unusual mileage, and physical condition. The prices are not official and these publications are not considered an appraisal of any specific donated property. But they do provide clues for making an appraisal and suggest relative prices for comparison with current sales and offerings in your area.

Example. You donate your car to a local high school for use by their students studying automobile repair. Your credit union told you that the blue book value of the car is 1,600. However, your car needs extensive repairs and, after some checking, you find that you could sell it for for 750. You can deduct 750, the true fair market value of the car, as a charitable contribution.

Determining the Value of Donated Property:

This publication is designed to help donors and appraisers determine the value of property (other than cash) that is given to qualified organizations. It also explains what kind of information you must have to support the charitable contribution deduction you claim on your return. IRS Publication 561

If you donate a car to a charitable organization, YOU must determine its fair market value. The fair market value of your vehicle cannot be determined by a charity, the IRS considers that to be a conflict of interest. Kelley Blue Book can help you determine your vehicle’s value.

Start by logging on to http://www.kbb.com .
[Click on: �Used cars at top, and select the year. make and exact model of your vehicle, then press. Select Private Party Value . ]

You also need to fill in the exact mileage on the car and the zip code in which you will be stating that you live on your tax return.

To help further define your specific vehicle’s value, make sure you accurately select the options on your vehicle. These could include a sunroof, leather interior, power windows and door locks, etc. Check these boxes correctly according to your car and check all that apply.

The bottom box is entitled Select Vehicle Condition . Choose Help Me , which is the last box on the right. This is important in order to accurately get what the IRS deems as the fair market value for your vehicle.

After choosing Help Me click on the bottom button called, Get Pricing Report .

On this page you rate the following: Exterior Condition, Interior Condition,
Mechanical Condition
. and other important factors in rating your vehicles current condition. Choose one rating for each. Do not skip any of these questions. Print this page to show the charity and the IRS that you took the vehicle’s current condition into consideration when placing a value on it.

When finished, click on Get Pricing Report at the bottom of the page. You will then receive the Kelley Blue Book Private Party Value for your car in its current condition. This will be the value you will use for your donated vehicle. You should print a few copies of this page for your tax records, the IRS and for the charity in which you are donating your vehicle. Make sure to take several photos of your vehicle for your files as well.

If the amount of your deduction for all non-cash gifts is more then 500.00 then you must file the IRS Form 8283: Non-cash Charitable Contributions (http://www.irs.gov/pub/irs-pdf/f8283.pdf ) with your itemized tax return. A copy should be mailed to the charity or donation program.

The IRS requires that the charity or donation program verify your donation and file IRS Form 8282: Donee Information Return (www.irs.gov/pub/irs-pdf/f8282.pdf ). You should be sent a copy for your records.

When you make any non-cash contributions, you must get and keep a receipt from the charitable organization showing: Name of the charity, date and location of the charitable contribution, and a detailed description of the donation. This receipt also includes the charity’s tax identification number for your records.
